Breaches of F-Gas Regulations will result in heavy fines

The F-gas Regulation which aims to contain, prevent and thereby reduce emissions of HFC/PFC based refrigerants. The F-gas Regulation states that any systems that have over 3KG of refrigerant, must have an annual leak detection test. This Regualtion is effective as of the 4th of July 2007.

The regulations state that a person found guility of an offence in a Magistrates’ Court is liable of a fine up to £5,000 on summary conviciton and an unlimited fine on conviction in the Crown Court.

Liabilities rest with the system operator which is defined as the person or legal person (typically a company) who is responsible for giving instructions to its employees as to the day to day technical functioning of the equipment.

There are a number of specific legal obligations on the operator: he/she must take the necessary action to prevent leakage, arrange for the repair of any leaks as soon as possible and arrange for further checks on the site of the repair to ensure there are no further leaks. The operator must also arranage proper refrigerant recovery by a certififed personnel durring servicing and disposal.

 The engineer carrying out the leak detection test must produce a log book, that has the information stated below;

·         Model number of the unit

·         Serial number

·         Date of installation

·         Type of refridgerant

·         Manufacturer refridgerant charge

·         Additional refrigerant charge

This log book must be filled in each time a serivce, call out or leak detection visit is completed to keep a log of the amount of refrigerant added or taken from each system.

The system shall have log book, which will be permantly located inside the housing of the condensing unit. The engineer carrying out the sevice, call or leak detection visit, shall log down the results of the visit as well as any refridgerant that has been added or reclaimed.
